Terms of Service

These terms are an agreement between you and [LEGAL ENTITY NAME] ("Journey Saga", "we", "us"). They apply when you use journeysaga.com and when you stay with us. By making a reservation you accept them on behalf of everyone in your group.

What Journey Saga is

We reserve entire private estates in Puerto Rico for a single group, with hospitality service included: daily breakfast, a Journey Host, standard departure cleaning, and optional premium experiences you can add. We are not a hotel, and we are not a listings marketplace. For each Journey we either operate the property or act as the owner's agent in managing bookings and service. Premium experiences are delivered by independent providers, and businesses in the Adventure Guide are independent too. Section 7 explains what that means for you.

1. Who can book

The lead guest must be at least 25 and must stay at the property for the whole reservation. You are responsible for everyone in your group, including children, and for making sure they follow these terms and the property rules. You must give accurate information when booking, including a correct final guest count. Bookings made under a false name, or where the stated purpose differs materially from the actual one, may be cancelled without refund.

2. Reservations and when the contract forms

A request is not a booking. The contract forms when we confirm your reservation in writing and your first payment is taken. Until then, dates and pricing are not held. We may decline a booking. Reasons include the property being unavailable, the group exceeding capacity, a failed payment, or a prior breach of these terms.

3. Pricing, taxes and payment

Pricing is per person, per night, and the per-person rate falls as the group grows. The rate shown depends on your group size against the property's capacity tiers, and on whether your dates fall in a peak window. Peak windows and their multipliers are shown before you pay. On top of accommodation we add Puerto Rico government room tax at 11.5% and a service fee of 5% of the accommodation subtotal. Premium experiences are priced separately and taxed at the same rate. Payment is in two parts: a deposit at booking, and the balance 30 days before check-in. If the balance fails and is not resolved within 5 days of notice, we may cancel and treat it as a cancellation inside the 30-day window under section 4. Prices are in US dollars. An obvious pricing error, a figure clearly wrong by an order of magnitude, does not bind us; we will tell you promptly and you may cancel for a full refund.

4. Changes and cancellation

More than 30 days before check-in.

Cancel for a full refund. You may also change dates or group size subject to availability; a change in group size or season may change the price.

30 days or fewer before check-in.

The reservation is non-refundable, including any Personalized Experience Package attached to it. At that point we have committed on your behalf: your Journey Host is scheduled, providers are booked and paid in advance, and the property is held exclusively for you and turned away from other requests.

This applies equally to everyone. We recommend travel insurance covering cancellation, and we cannot make exceptions for illness, weather, flight disruption or change of plans.

To cancel, email [PRIVACY EMAIL] or contact your Journey Host. The cancellation takes effect when we receive it, not when you send it.

If we cancel.

If we have to cancel for a reason within our control, you receive a full refund and we will help you find an alternative. If a property becomes unusable through no fault of ours, storm damage, utility failure, government order, we will offer a comparable alternative, a date change, or a full refund. Our liability in that case is limited to the amount you paid.

Refunds go back to the original payment method within 10 business days.

5. Your stay

Capacity.

The guest count you booked is a hard limit. Additional overnight guests are not permitted without written approval, and may result in an additional charge or removal from the property.

Check-in and check-out

times are confirmed with your reservation. Late departure without agreement may incur an additional night's charge.

Events.

Weddings, parties and commercial shoots need written approval in advance. Approval may carry conditions and an additional fee.

Conduct.

No smoking indoors. No illegal drugs. Respect quiet hours and neighbours. Do not exceed the stated capacity of pools or other amenities, and supervise children around water at all times. We may end a stay without refund for serious or repeated breaches.

Access.

Staff and providers need access at scheduled times for breakfast, cleaning, maintenance and the experiences you booked. We give reasonable notice except in an emergency.

6. Damage and your responsibility

You are responsible for damage to the property or its contents caused by your group, beyond ordinary wear. We do not take a security deposit. If damage is found after departure we will tell you within 7 days, with photographs and either a repair quote or a replacement cost, and invoice you for it. You may dispute a claim, and we will not charge a disputed amount without discussing it with you first.

7. Premium experiences and independent providers

Chefs, bartenders, massage therapists, yoga instructors, musicians and decorators are independent businesses. We coordinate scheduling and payment as your agent, and we select them with care, but they are not our employees and we do not control how they work. Our responsibility is to arrange the service and put it right if it is not delivered, by rescheduling or refunding that experience. We are not liable for the acts or omissions of a provider beyond that. Experiences are subject to minimum notice, minimum spend and provider availability. Some carry their own age or health restrictions. Tell us about allergies and medical conditions before the service; we pass them on, but we cannot guarantee an allergen-free environment.

8. The Adventure Guide

The Adventure Guide lists independent restaurants, tours, beaches and attractions. A listing is not a recommendation we stand behind, and we have no control over those businesses. Prices, hours and availability change without notice. Your dealings with them are your own.

Journey Pass.

Your pass may entitle you to a discount at participating partners during your stay. It is personal to your reservation, valid only for your stay dates, not transferable, and has no cash value. Partners may withdraw at any time, and we are not liable if a partner declines to honour a pass.

For partner businesses.

If you list in the Adventure Guide, a separate partner agreement governs your listing, the weekly fee and the discount you commit to. You are responsible for the accuracy of your listing, and you grant us permission to display your name, description and images. Either side may end the listing with written notice; fees already paid for the current period are not refunded.

9. Property owners

If you list a property with us, a separate management agreement governs it and takes precedence over these terms where they conflict. Nothing here creates an obligation for us to accept a property.

10. Accounts

You are responsible for what happens under your account and for keeping your password to yourself. Tell us promptly if you think someone else has access. You may invite others to a reservation; they see the itinerary, not your payment details. We may suspend an account used to breach these terms.

11. Our content

The site, its text, photographs, logos and the Journey Saga name belong to us or our licensors. You may not copy or reuse them commercially without permission. Photographs of properties are representative; furnishings and layouts change. If you post a review or send us photographs, you give us permission to display and use them in our marketing, with attribution to your first name and initial. You keep ownership, and you can ask us to stop using them.

12. What we do not promise

We aim to describe every property accurately, but minor differences between the listing and the property are possible. Amenities may be temporarily unavailable for maintenance or reasons beyond our control. Where something material is unavailable we will tell you and offer a reasonable remedy. The site is provided as it is. We do not warrant that it will be uninterrupted or error-free.

13. Limits on liability

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, our total liability arising from your reservation is limited to the amount you paid for it. We are not liable for indirect or consequential loss, including travel costs, lost earnings or disappointment. We are not liable for failures caused by events beyond our reasonable control, including storms, hurricanes, flooding, earthquakes, power or water failure, strikes, epidemics, or government action. You agree to cover us against claims arising from your group's breach of these terms or damage caused by your group.

14. Governing law and disputes

These terms are governed by the laws of [STATE OF FORMATION], and the courts there have jurisdiction. If something goes wrong, contact us first, most problems are resolved quickly. If we cannot resolve it within 30 days, either side may pursue it formally. Nothing here removes a consumer right you have under the law of your home country.

15. Changes to these terms

We may update these terms. The version in force for your reservation is the one you accepted when you booked. Changes apply to bookings made afterwards, and we will show a notice on the site before they take effect.
